We reserve the right to refuse or cancel orders where necessary, including but not limited to pricing errors, stock inaccuracies or suspected fraud.
4. Product Nature & Characteristics
Maison Patina specialises in handcrafted, hand-dyed and restored leather furniture, including pre-loved and vintage pieces.
You acknowledge that:
- Leather is a natural material with inherent variation in grain, texture and tone.
- Hand-dyed finishes may vary slightly from images displayed.
- Pre-loved and vintage items will show signs of age and character.
- Measurements are approximate and may vary slightly.
These characteristics are not defects.
Colour representation may vary depending on individual screen settings.
5. Pricing & Payment
All prices are listed in GBP (£) unless stated otherwise.
We reserve the right to amend pricing prior to order confirmation.
Full payment is required before dispatch unless agreed otherwise in writing.
Payment is processed securely via Shopify Payments or approved third-party providers.
6. Delivery & Risk
6.1 Delivery Estimates
Delivery times are estimates only and are not guaranteed.
We are not liable for delays caused by third-party couriers, customs processes, weather or events beyond our reasonable control.
6.2 Customer Access Responsibility
The customer is solely responsible for ensuring:
- Adequate access for delivery
- Suitable doorways, staircases and lifts
- Safe and clear unloading conditions
- Structural suitability of placement areas
If delivery cannot be completed due to access restrictions:
- Redelivery and/or storage charges will apply
- We reserve the right to cancel the order subject to deduction of incurred costs
6.3 Inspection on Delivery
Goods must be inspected upon delivery.
Visible damage must:
- Be noted on delivery documentation
- Be reported in writing within 48 hours
Failure to notify us within 48 hours may invalidate claims relating to transit damage.
6.4 Transfer of Risk & Title
Risk passes to you upon delivery.
Ownership of goods passes only once full cleared payment has been received.
7. Cancellations & Returns
Your statutory rights under the Consumer Contracts Regulations 2013 remain unaffected.
7.1 Standard Distance Sales
You may cancel within 14 days of delivery.
Returned goods must be:
- In original condition
- Unused
- Properly packaged
Return transport costs for large furniture items are the responsibility of the customer unless the goods are faulty.
7.2 Exclusions
The following are non-refundable unless faulty:
- Made-to-order or bespoke items
- Custom hand-dyed finishes
- Personalised or modified pieces
7.3 Pre-Loved & Vintage
Pre-loved and vintage items are sold as described.
Age-related wear, patina and character are not faults.
8. Fire Safety Compliance
Items within our New Collection comply with the Furniture and Furnishings (Fire) (Safety) Regulations 1988 (as amended).
Pre-loved and vintage items may not comply with current regulations and may not carry modern compliance labels.
By purchasing vintage items, you acknowledge this position.
9. Product Care
Customers are responsible for following care instructions.
We are not liable for damage caused by:
- Sunlight exposure
- Heat sources
- Improper cleaning
- Misuse or neglect
Natural ageing of leather is not a defect.
10. Intellectual Property
All content, imagery, branding, product descriptions and design elements on this Website are the property of Maison Patina Ltd and may not be reproduced without written consent.
11. Website Use
You agree not to:
- Use the site unlawfully
- Upload malicious software
- Interfere with website security
- Collect personal data unlawfully
We reserve the right to suspend access for breach.
12. Limitation of Liability
Nothing in these Terms excludes liability for:
- Death or personal injury caused by negligence
- Fraud or fraudulent misrepresentation
- Any liability that cannot legally be excluded
Subject to the above:
- Our total liability shall not exceed the purchase price paid for the product.
- We shall not be liable for indirect, incidental or consequential loss, including loss of business or revenue.

14. Force Majeure
We are not liable for failure or delay caused by events beyond our reasonable control, including supply chain disruption, transport interruption or governmental action.

The courts of England and Wales shall have exclusive jurisdiction.
